Kim Kardashian’s Lawsuit with Old Navy Continues

Last year, Old Navy commercials featuring a sexy and beautiful singer hit the airwaves, and viewers immediately began talking—not talking about the singer’s voice or dance skills, but rather her striking resemblance to Kim Kardashian. The curvy reality star was not happy. In July, she filed suit against Old Navy for using a model who looked like her. Her claim was that the resemblance created confusion in the marketplace, implied that she was endorsing Old Navy, and violated her intellectual property. At the time, Kardashian argued that her reputation was damaged by the use of a lookalike. Yes, the former sex tape star is worried about the ramifications of alignment with family-oriented Old Navy. She’s reportedly seeking $20 million. Now Fashionista.com is reporting that The Gap, the parent company that owns Old Navy, is ready to fight back, and Kim’s “reputation” will be the foundation of their case. The Gap’s high-powered attorney Louis Petrich is setting out to determine the value of her reputation, according to the Hollywood Reporter. The legal team’s research includes looking at Kardashian’s financial records from her deals with retailers Bebe and Sears, and uncovering the reasons why Bebe dropped Kardashian. THR speculates that The Gap intends to argue that Kardashian is “libel-proof” because her reputation is already so tarnished that “no injury could cause true damage.” Though we won’t be seeing Kardashian and The Gap go head-to-head in court for quite some time—the “investigation” is expected to take up to a year—the trial should be rather interesting when it finally happens, especially because ex-boyfriend Reggie Bush is expected as a witness.
